It was held that its fanciful or arbitrary meaning predominates over its purely geographical significance that it would be understood by the purchasing public as an arbitrary word designating origin or ownership. The Patent Office refused to register ALABAMA-TUBE on the ground that the word can mean nothing different from the two words of which it is composed, Alabama and Tube, meaning of course a tube produced in Alabama. The Patent Office held the word CLINTON as applied to wagons, geographical, on the ground that it is essentially a name known first in geography. It might be said in connection with this word that every Clinton in every state in this country traces the origin of this word to a celebrated historical character, and therefore there is something to say in the contention that it is not merely geographical. Except for the fame of General Clinton in the Revolutionary Army, the states of this country would not have been dotted with townships, counties and towns bearing this name. The Patent Office refused to register the word MODOC on the ground that it is the name of an Indian tribe. In Section 5 of the law, it is provided that the names of foreign nations cannot be registered as trade marks. Foreign nations include our own Indian tribes which are held to be wards of the general government and not citizens. It is true that some states are giving Indians citizenship, and it is also true that many of the tribes have disappeared. The Patent Office is apparently loosening up in its objection to the registration of names which are Indian tribes. The word SHAWNEE has recently been registered for certain food articles. The word AMHERST which is also the name of a college founded by a man of that name, was held to be geographical, ..
